What is mediation?

It is a voluntary process in which two or more parties, with the help of an impartial professional mediator, generate their own solutions in order to reach an agreement, reestablishing dialogue and communication.

How? Has the outside perspective that ensures efficient and clear communication, offering everyone the turn to speak and explaining all the positions.

A conflict is a situation in which two or more people disagree because their opinions or interests are incompatible.

PREPARATION OR PLANNING

The mediator will determine the purpose of the mediation, will gather the information, and will consider the strategy of the mediation. In this phase, a SWOT* analysis will be performed. (*SWOT - "strengths, weaknesses, opportunities, threats").

DISCUSSION OR NEGOTIATION

The mediator will create a climate of trust and the basis for negotiation by identifying common interests and conflicting interests in order to make the latter disappear.

PROPOSALS

Phase in which the parties will approach positions. The parties may then give up or give in to something in seeking a balance.

AGREEMENT

This phase will occur if an agreement has actually been reached, which will be reflected in an act signed by both parties.

CONTROL OR COMMITMENT

Phase in which the parties agree to make effective what was agreed in the mediation act.
